Booking Terms and Conditions

Please take some time to read all the booking terms and conditions below.


Tembo Treks is operated by TEMBO TREKS LLC.


AGREEMENT

By booking a trip with us you are agreeing to these terms (which serves as an agreement between you and us), and we will accept your booking based on these terms. The services, tours, trips, and treks mentioned are those referred to in your booking confirmation.


BOOKING CONTRACT

We will send you an invoice for 10% of the total booking cost (the deposit) which you must pay to confirm your booking.


We will send you a booking confirmation via email after we accept your payment. Once we accept your payment, a contract will exist starting from the date we accept your payment and/or from when we issue you your booking confirmation (whichever comes first).


Once your booking is confirmed, all modifications can only be made by contacting us via email and providing your booking reference.


WEBSITE

All information on the website is subject to change at anytime at the discretion of Tembo Treks.


We reserve the right to modify/correct mistakes/errors that may possibly appear on the website, or the published prices for any tours.


PRICES

All prices listed on this website are in USD. Prices may be subject to change at anytime at the discretion of Tembo Treks.


The prices listed may vary at any time for any number of reasons, including and not limted to: demand, availability, and market conditions. It can very much be a possibility that different passengers on the same trip be charged different prices.


The prices listed on our website do not include any tips for the guides, porters, and chefs. It is recommended that you bring separate cash for tips.


PAYMENT

We accepts all major credit and debit cards.


If you would like to pay via an ACH/electronic bank transfer, please email us and we can provide the necessary details.


PASSENGER DETAILS

You will need to provide us with all accurate details when making your booking so that we can make the appropriate travel arrangements for you. These details include and are not limited to: full legal name (as shown on your passport), date of birth, place of birth, nationality, passport number, passport issue date, passport expiration date, passport issuing country, food allergies, and any pre-existing medical conditions or medical conditions that we need to be aware of.


ITINERARY CHANGES

Please note that travel of this nature involves flexibility and you should allow and plan for alternatives. Due to some local or unforeseen circumstances or events, certain aspects such as but not limited to: routes, schedules, itineraries, amenities, and transportation provided may change without prior notice.


If we make a significant change to an itinerary before your departure date, we will inform you of the change as soon as reasonably possible.


If we make a change to an itinerary on or after the departure date due to a local circumstance or an event outside of our control, it is considered an emergency change. In these circumstances, the additional cost of any necessary alterations will be paid by you. Please note that we are not responsible for any incidental expenses that can incur as the result of a change of itinerary, such as but not limited to: airlines, accommodations/hotels, immunizations/vaccinations, or visas.


CANCELLATIONS

There can be two types of trip cancellations: one by the passenger (you), and one by us. Each type of cancellation carries with it a different set of rules.


CANCELLATION BY US

All of our trips are guaranteed to depart once you have paid for your booking and your booking is confirmed. On some occassions, trips may be cancelled prior to departure due to events such as but not limted to: weather, terrorism, geo-political issues and political instability, natural disasters, or anything else that may hinder us from undertaking the trip as planned. In an event we do cancel our trip, we will either issue you a full refund, or alter your trip to a future date free of charge. If we cancel a trip due to circumstances outside of our control, we will not be able to refund you any unrecoverable costs. We are also not responsible for any incidental expenses that you may incur or have incurred as a result of your booking, including but not limited to: items you may have purchased, immunizations/vaccinations, visas, travel insurance, and non-refundable flights.


CANCELLATION BY THE PASSENGER (YOU)

Once your booking has been confirmed, if you choose to cancel some or all of your trip, you will need to write to us via email requesting the cancellation. Please note that you will incur cancellation fees.


- If you cancel your trip prior to 90 days prior to the earliest departure date, we retain 10% of the total paid for the booking (the deposit), and you are refunded the remaining 90%.


- If you cancel your trip between 89 and 60 days prior to the earliest departure date, we retain 25% of the total paid for the booking, and you are refunded the remaining 75%.


- If you cancel your trip between 59 and 30 days prior to the earliest departure date, we retain 50% of the total paid for the booking, and you are refunded the remaining 50%.


- If you cancel your trip between 29 and 15 days prior to the earliest departure date, we retain 75% of the total paid for the booking, and you are refunded the remaining 25%.


- If you cancel your trip 14 days prior to the earliest departure date, we retain 100% of the total paid for the booking.


The cancellation and refund policy above applies even if you need to cancel your trip for reasons including but not limited to: sickness, hospital visits, missed flights, missed transportation, traffic congestion, or any other reason not mentioned here. We also do not offer any refunds if you decide to abandon or leave a trip after it has commenced. Please note that any charges levied by (and not limited to) airlines, transportation services, travel agents, hotels or accommodation services, or third party tour or travel services will not be refunded, and will be charged directly to you in addition to any cancellation fees you incur. It is highly advised and recommended that you take out insurance for your trip that covers cancellation costs.


BOOKING CHANGES

If you wish to alter your trip departure date, you will need to write to us via email and let us know at least 15 days prior to your current earliest trip departure date. We will charge you USD 125 per change per person. You may transfer your trip to another third party, provided that the transferee meets all the requirements of the trip, including signing a liability waiver and accepting these terms and conditions. Please note that you will be responsible for fees charged by and not limited to: airlines, transportation services, travel agents, hotels or accommodation services, or third party tour or travel services.


We do not accept any booking changes within 14 days of your trip departure date.


The booking changes policy above applies even if you need to change/modify your trip for reasons including but not limited to: sickness, hospital visits, missed flights, missed transportation, traffic congestion, or any other reason not mentioned here. We also do not offer any refunds if you decide to abandon or leave a trip after it has commenced. Please note that any charges levied by (and not limited to) airlines, transportation services, travel agents, hotels or accommodation services, or third party tour or travel services will not be refunded, and will be charged directly to you in addition to any cancellation fees you incur. It is highly advised and recommended that you take out insurance for your trip that covers cancellation costs and trip change/modification costs.


Please note: Any accommodations and flights that are booked that are part of your itinerary are either not refundable OR subject to additional costs and charges.


BOOKING INCLUSIONS/EXCLUSIONS

Your booking includes: all park fees and climbing permits, accommodation as per itineraries, meals as per itineraries, transportation as per itineraries, sightseeing as per itineraries, the services of the crew (guides, chefs, porters) as per the itineraries.


Your booking excludes (not limited to): gear, tips for porters/guides/chefs, international or domestic flights unless otherwise mentioned as per itineraries, airport transfers, taxes, baggage charges, unless otherwise mentioned, meals not mentioned in the itineraries, transportation not mentioned in the itineraries, services of the crew not mentioned in the itineraries, visa and passport fees, travel insurance, and personal expenses.


GEAR RENTAL

To rent gear, you will need to pay cash (preferrably USD, but TSh is also accepted) to our guide when they meet you in Arusha/Moshi. You are responsible for any damage or loss to any of the gear that you rent.


PASSPORT/VISAS

Please note that it is your responsibility to carry a valid passport and obtain all necessary visas, permits and documents for the countries which you will visit during your trip. You must travel with a passport that is valid for at least 6 months beyond the duration of your trip. We are not responsible if you are refused entry into the country due to lack of proper documentation, records, visas, permits, passport, or any other reason.


AGE REQUIREMENTS

There is no minimum age for our safari trips, but for our Mt. Kilimanjaro trips, we require all passengers to be at least 10 years old. All passengers under the age of 18 must be accompanied by a legal guardian, or an escort over the age of 18, appointed by their legal guardian. The designated legal guardian or the escort will be responsible for the passenger's day-to-day care.


While there is no maximum age for any of our trips, please do note that some of our trips may be physically challenging and demanding, and it is the passenger's responsibility to ensure that they are fit to participate on the trip. We are not medical experts, but we can provide more details on health requirements. It is the passenger's responsibility to get a medical evaluation and a clearance from their doctor before participating in any of our trips.


TRAVEL INSURANCE

It is highly advised and recommended that all passengers purchase travel insurance for their booking. Your travel insurance must provide you cover against personal accident, death, medical expenses, emergency evacuation and emergency repatriation with a minimum coverage of USD 200,000 for each of the coverage categories. It is also strongly advised that your insurance also cover you for trip cancellation, personal liability, loss of luggage and personal items. Please provide us with your travel insurance details (company name, policy number, and 24-hr contact hotline) at least a day before or on the first day of your trip. If you have your insurance connected to your credit or debit card provider, please have those details handy as well.


TOUR GUIDE/LEADER

All of our trips are run with a tour guide, who also serves as the group leader. All the decisions made by the guide are final on all matters that relate to safety or the well-being of any passenger or the traveller of the group. Failing to obey and comply with the guide's decision, or jeopardizing the well-being or mobility of the group, will result in the guide asking you to leave the group immediately with no right to refund. You must always comply with all local laws, customs, foreign exchange and drug regulations.


QUALITY / FEEDBACK

It is our highest priority to provide excellent customer service to every customer, every time


If for some reason you are dissatisfied with your trip, we want to hear about it immediately. Please inform the tour guide about your reason and also reach out to us after your trip.

TRIP RISK

Please understand that trips of this nature that involve adventure, carry a certain amount of personal risk. You will be traveling in a region where the political, cultural, and geographical aspects may pose dangers or challenges greater than what you may be accustomed to in your everyday life. We use all acceptable information at our disposable to do our best to ensure the situation is safe before we operate our trips. It is also your repsonsibility to acknowledge and understand the travel information in accordance with your trip, and you are deciding to travel on your own volition after understanding all personal risks associated with this type of travel and your trip.


LIABILITY

We assume no responsibility for any act of negligence or omission whatsoever, by any company or agency whose services are used as part of services provided.


To the fullest extent permitted by the law:


- Any liability for any loss, death, injury, or damage which you may incur (whether directly or indirectly) in connection with or arising out of your participation in any of our trips, or any breach of these terms and conditions is excluded.


- You release us, our employees, our officers, our agents, our contractors, and our representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in any of our trips.


- Any condition or warranty which would otherwise be implied by law into these terms and conditions (Implied Warranty), is excluded.


To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (i) the provision of a similar trip to an equivalent value; (ii) a refund of the total amount received by us from you in connection with your booking.


Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive, or exemplary damages.


ACTIVITIES OUTSIDE YOUR TRIP

Activities that are not included in your trip or your itinerary that are not included as part of the price for this trip or booking are not a part of this contract. You accept and acknowledge that any assistance or suggestion given by your tour guide or leader or local representative in arranging an activity that is option and not part of your booking that you paid for does not render us liable for them in any way. The contract for the provision of that activity will be between you and that activity provider.


PHOTOS & VIDEOS

You acknowledge that photos and videos taken of you during your trip can be used for advertising and marketing purposes in any medium we choose. You grant us a perpetual, royalty-free, world-wide, irrevocable license to use such photos and videos for publicity, promotional, and marketing purposes.


SEVERABILITY

In the event that any term or condition contained in these terms and conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.


PRIVACY POLICY

Any personal information that we collect about you may be used for any purpose associated with the operation of a trip or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the trip. We will otherwise treat your details in accordance with our privacy policy (available for viewing on our website).


FITNESS AND PARTICIPATION

Tembo Treks tours are varying in difficulty. Our Kilimanjaro tours are demanding and require adequate fitness levels, whereas our safari tours are relatively easy.


As much as we want all of our clients and customers climbing Mt. Kilimanjaro to have the wonderful experience of summiting the mountain, we cannot guarantee it. Summiting is at the guides' discretion. If you are showing signs of sickness or weakness, or if our guides feel that you are not capable of summiting, or if our guides feel that attempting to summit may be harmful or injurious, then you do not summit - this is completely at the guides' discretion. We prioritize safety over summiting.
